2. How to Submit a DMCA Notice

Please note that we may not respond to incomplete or improperly formatted DMCA notices. We recommend seeking legal counsel before submitting a notice to ensure it meets all legal requirements.

3. Takedown Procedure

Upon receiving a valid DMCA takedown notice, we will:

1. Acknowledge receipt of the notice within 48 business hours.
2. Investigate the claim in good faith.
3. Remove or disable access to the allegedly infringing material promptly if the claim is found to be valid.
4. Notify the user who posted the content about the takedown (if applicable).
5. Maintain a record of the notice and our response.

4. Counter-Notification

If you believe that material you posted on our Site was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our designated copyright agent. Your counter-notification must include:

1. Your full legal name, mailing address, telephone number, and email address.
2. Identification of the material that was removed or disabled and the location at which it appeared before it was removed or disabled.
3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
4. A statement that you consent to the jurisdiction of the courts in your district and that you will accept service of process from the party who submitted the original DMCA notice.
5. Your physical or electronic signature.

5. Repeat Infringers

In accordance with the DMCA and other applicable laws, AdBurner Communication has adopted a policy of terminating the accounts of users who are determined to be repeat infringers in appropriate circumstances. We also reserve the right to limit access to the Site and/or terminate the accounts of users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

6. Product Images and Descriptions

Product images and descriptions on our Site are sourced from manufacturers, official brand resources, and authorized distributors. If you are a brand owner or manufacturer and believe that product images or descriptions on our Site are being used without proper authorization, please contact us directly so we can verify and resolve the matter.

7. Good Faith

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorney fees incurred by us or the alleged infringer. Filing a false DMCA notice or counter-notification is a serious matter. We encourage you to consult with a legal professional before filing a notice or counter-notification.
